Aixperia User Agreement

This Agreement is an agreement signed between users and Aixperia Group regarding the use of Aixperia Platform related services and has a contractual effect.

When you use a specific service of Aixperia Platform, the service may have separate agreements and related business rules published via website announcements, notifications, messages, e-mails and help center documents. Once officially released, such separate agreements shall be considered as an integral part of this Agreement.

The content may be modified due to changes arising from national policies, products and environment. The revised agreement will be posted on this website. If you disagree with the revised agreement, please stop using Aixperia Platform immediately.

You may enter into orders with Aixperia Platform, whether online or offline. If there is any conflict between this Agreement and the orders, the orders shall take precedence.

Aixperia Platform provides you with services such as online design tool applications, online home design transaction information release, transaction services, rendering services, and online design training. The specific details are subject to the services provided by Aixperia Group.

You may use Aixperia Platform only if you agree to form this Agreement with us and are not a person barred from receiving services under the laws of the applicable jurisdiction. In any case, you must reach the age of majority under applicable jurisdiction.

If you are accepting this Agreement on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to this Agreement.

Your privacy is of great importance to us. Please read the Aixperia Privacy Statement as it describes the types of personal data we collect, how we use it, and the legal basis for processing. In some cases, we will provide separate notices and request your consent.

Please carefully keep your account information. Your account can only be used by you and is prohibited from being transferred, traded, donated, rented or borrowed. We reserve the right to ban accounts found in violation.

You may be required to complete real-name authentication and provide identity materials for certain features. You must provide true, latest, valid and complete information.

Notify us immediately of any unauthorized use or breach. We will not be liable for losses from password or account misuse.

Some services charge fees. Details are in business rules and notifications. We may modify charging standards and methods, and may charge for previously free services. Changes will be announced before implementation.

You undertake not to use Aixperia Platform for any illegal purpose and to comply with all applicable laws and separate agreements.

If violations are found, we may require content modification, delete/block content, restrict/suspend services, or terminate your account. We will provide a complaint channel via email, message, SMS or phone.

We may adjust or terminate services with justified reasons including: regular maintenance, force majeure, technical faults, network security incidents, improper user operations, unauthorized use, or other uncontrollable situations. Free service changes do not require notification.

If terminated for any reason, data will be kept as long as your account exists. You must complete migration and backup promptly. After the retention period, all data will be automatically deleted.

Suspension or termination does not terminate your responsibility for possible breach of contract or damages during use.

Third-party service responsibility is borne by the third party. We do not provide warranty or condition to any user or transaction. You bear all risks based on your own trading objectives and risk tolerance.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIXPERIA GROUP DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. IN NO EVENT SHALL AGGREGATE LIABILITY EXCEED $100.00 OR THE AMOUNT PAID IN THE PAST SIX MONTHS.

We give you a personal, royalty-free, non-assignable license to use Aixperia Platform. All intellectual property rights belong to Aixperia Group or other right holders. No one shall use, modify, reproduce, or distribute content without written agreement.

This Agreement shall be governed by the laws of the Indian Penal Code. Disputes shall be settled through friendly negotiation. If no settlement is reached, disputes shall be referred to arbitration by the Singapore International Arbitration Centre (SIAC Rules). The arbitral award shall be final and binding.
